Via Platform Content Policy

This policy describes the types of information that is not permitted on the Via platform. The policy applies to all services offered by Via, including but not limited to SMS, MMS, and email. By using Via’s platform, you agree to this Content Policy. Via reserves the right to refuse, cancel, or suspend access and use of the Via platform based upon noncompliance with this policy.

Via Client (“Client”) or perspective client websites, SMS, MMS, journeys, grow-links, pop-ups, call-to-actions may not contain any of the following content:

Pornographic content

The Via platform does not permit any pornographic, obscene, or sex related content.

Hateful or violent content

The Via platform does not permit content which we deem as violent or hateful. This includes, but is not limited to:

  • Content that promotes discrimination, incites hate against, or disparages individuals based on any protected characteristics as defined by the equal opportunity act and various other legal requirements:
  • Age
  • Disability
  • Ethnicity
  • Gender Identity
  • Nationality
  • Race
  • Immigration/Citizenship Status
  • Religion
  • Sexual orientation
  • Veteran status
  • Victims of heinous events
  • Threats of death or physical harm, depictions or endorsement of violence or physical harm, or any other content harmful to children below the age of 18.
  • Malicious spread of hate and/or misinformation.
  • Libelous, defamatory, profane, and otherwise malicious speech.

Alcohol/Drug Related Content

The Via platform does not permit content that is related to the sale of alcohol and drugs. 

Additionally, the Via content cannot be used for the sale of any State or Federally illegal substance, including CBD, Cannabis, or other products which are Federally legal or legal in every state.

Sale of Firearms

The Via platform does not permit content related to the sale of firearms. However, content related to the sale of firearm related merchandise is acceptable. 

Tobacco Related Content

The Via platform does not permit content related to the sale of tobacco products. This includes vape pens and other vaping products.

Protected Health Information

Protected Health Information includes all information as defined by HIPAA (Health Insurance Portability and Accountability Act of 1996). This is information that “relates to the past, present, or future physical or mental health condition of an individual; the provision of health care to an individual; or the past, present or future payment for the provision of health care to an individual.

Content which violates the Intellectual Property rights of any third party.

  • Content that infringes, violates, or misappropriates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
  • Content that you do not have a right to make available under law, contract, or fiduciary relationship (such as inside information, proprietary, and confidential information).
  • The export, re-export, or transfer of restricted software, algorithms, or other data in violation of export control laws.

Sensitive or Protected Data

Sensitive and Protected Data includes:

  • social security number, passport number, driver’s license number, or similar identifier (or any portion thereof); 
  • credit or debit card number (other than the truncated (last four digits) of a credit or debit card), financial information, banking account numbers or passwords; 
  • employment, financial, genetic, biometric or health information; 
  • racial, ethnic, political or religious affiliation, trade union membership, or information about sexual life or sexual orientation; 
  • account passwords, mother’s maiden name, or date of birth; 
  • criminal history; or 
  • any other information or combinations of information that falls within the definition of “special categories of data” under GDPR or any other applicable law relating to privacy and data protection.

Fraudulent, Deceptive, or Malicious Content

The Via platform may not be used for fraudulent, deceptive, and/or malicious content. Fraudulent, deceptive, and malicious content means any impersonation of a person or entity, falsely representing affiliation with a person or entity, or posing as any other service or entity for any purpose. 

Gambling and Sweepstakes

Any content reasonably related to gambling is prohibited on the Via platform. This includes any game of chance played for monetary gain or other valuable consideration.

Illegal Content

Illegal content may not be promoted on the Via platform. Illegal content includes any content that is illegal in any state or federally, or the endorsement of any illegal substance as discussed above.

Marketing Aggregation Services

Marketing aggregation services include any service that is not directly marketing or selling products of their own but are instead marketing products on behalf of other brands. This prohibit includes all multi-level marketing schemes.

Direct Carrier Competition

The Via platform may not be used for any direct competition with the carriers providing the SMS services. This includes information on competing phone plans or SMS services.

High Risk Financial Services

The Via platform may not be used to advertise for any high-risk financial services, including, but not limited to:

  • Payday lending
  • Debt collection
  • Loan services not from direct lenders
  • Risk Investment Opportunities
  • Short term-high interest loans
  • Lead generation for any of these high-risk financial programs

Debt Forgiveness Services

The Via platform may not be used for any debt forgiveness services, including but not limited to:

  • Debt Consolidation
  • Debt Reduction
  • Credit Repair

Data Brokers

The Via platform cannot be used by any companies that buy or sell personal information, including lead generation services.
